Summary: trading on Broker Gain is always simulated with virtual cash. The platform and every championship are free — there is never an entry fee.
1. Acceptance of these terms
By creating an account and using Broker Gain, you agree to these Terms of Service. If you disagree with any provision, do not use the platform. You declare that you are at least 18 years old, or that you use the platform with the consent of your legal guardian.
2. Nature of the service
Broker Gain is an educational simulator for stocks listed on B3, NASDAQ, and NYSE, as well as cryptocurrencies. Market and limit orders use virtual cash only. The platform is not affiliated with these exchanges or with any brokerage, does not execute real-market orders, and does not hold, custody, or transfer assets on your behalf. Trading is 100% simulated at all times.
3. Not investment advice
Nothing on the platform constitutes an investment recommendation, advisory, consultancy, or portfolio-management service under Brazilian Securities Commission (CVM) rules. All content, history, and tools are informational and educational. Real investment decisions are your sole responsibility, and you should consult a professional registered with the CVM if you want personalised guidance.
4. Quotes and market data
Quotes come from market-data providers and may be delayed or differ from the real market. We do not guarantee their accuracy, timeliness, or continuous availability, and a discrepancy in quotes does not entitle you to any indemnity or to a revision of a championship result already published.
5. Free of charge, always
The platform and every championship are entirely free. There is no entry fee, subscription, deposit, minimum balance, ticket, or purchase of any kind required to create an account or to take part, under any circumstances. Any message asking you for money on our behalf is fraudulent and should be reported to the contact address at the end of this document.
6. Account and acceptable use
You are responsible for keeping access to your account secure and for any activity carried out through it. Each person may hold a single account. You may not use the platform unlawfully, create multiple accounts, use another person's data, automate trading to gain an unfair advantage, circumvent the platform's rules, manipulate rankings or results, or compromise the security or availability of the service.
7. Simulator and championships
Your default portfolio is a private simulator with an adjustable starting balance. Championships are free, time-limited events with a fixed starting balance and a fixed market region, played in a separate portfolio. While a championship is running, your simulator portfolio is paused and its balance cannot be changed. Championship rules and presentation may be adjusted for future events; the rules of a championship already open for registration do not change after the first participant registers.
8. Winning criterion
The winner is the participant with the highest final wealth (cash plus the value of held positions) at the championship's end date, calculated from the prices recorded by the platform at that moment. The platform's own calculation is the sole criterion for determining the result.
9. Disqualification
A participant may be disqualified at any time, before or after the result is published, in the event of: fraud or attempted fraud; more than one account held by the same person; manipulation of results, quotes, or the ranking; false, incomplete, or inconsistent registration data; or any breach of these terms.
10. Change, suspension, or cancellation of a championship
We may cancel a championship that has not yet started, or that has no participants, at no cost to anyone. If a championship is cancelled for technical reasons after it has started, we will either reschedule it or publish the standings as they stood at the moment of interruption, and we will inform participants of the decision on the platform.
11. Disclaimer and limitation of liability
The platform is provided “as is,” without a guarantee of uninterrupted or error-free service. We are not liable for real investment decisions based on simulator use, or for losses arising from unavailability of the service or of market-data providers. Nothing in these terms excludes rights that Brazilian consumer law grants you and that cannot be waived.
12. Account termination
You may request closure of your account at any time. We may suspend or close accounts that breach these terms when needed to protect the platform and its users. Closing your account does not remove records we are legally required to keep for the periods described in the Privacy Policy.
13. Changes to these terms
We may update these terms periodically. The latest revision date is shown above, and material changes are announced on the platform. Continued use after a change means acceptance of the revised terms. The version of these terms accepted at the time you register for a championship is the one that governs that championship.
14. Governing law and jurisdiction
These terms are governed by the laws of the Federative Republic of Brazil, in particular the Consumer Protection Code (Law No. 8,078/1990), the Brazilian Internet Civil Framework (Law No. 12,965/2014), and the General Data Protection Law (Law No. 13,709/2018). We do not impose an exclusive jurisdiction: as a consumer, you may bring any claim in the courts of your own domicile, as guaranteed by article 101, I of the Consumer Protection Code.
